OVERVIEW

Welcome to St. MACI. Throughout the site, the terms “we”, “us” and “our” refer to St. MACI.

St. MACI operates this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”), to provide you with a curated shopping experience. Our store is hosted on Shopify, which provides the ecommerce platform that allows us to sell our products to you.

These Terms of Service (“Terms”), together with any policies referenced herein (including our Privacy Policy and Refund Policy), govern your access to and use of the Services.

By visiting, browsing or purchasing from our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you confirm that you are at least the age of majority in your place of residence, or that you have obtained consent from a parent or guardian.

You may be required to provide personal information such as your email address, billing details and shipping address. You warrant that all information provided is accurate, current and complete.

You are responsible for maintaining the confidentiality of your account details and for all activity conducted under your account. You must not transfer or share your account with any third party.

SECTION 2 – OUR PRODUCTS

We take reasonable care to display our products accurately. However, colours and appearance may vary depending on your device and screen settings.

All product descriptions, imagery and pricing are subject to change at any time without notice. We reserve the right to discontinue or limit quantities of any product at our discretion.

SECTION 3 – ORDERS

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion.

An order is not confirmed until payment has been processed and you receive an order confirmation. Once confirmed, we may not be able to cancel or modify your order.

Returns and exchanges are governed by our Refund Policy, available on our website.

Purchases are for personal use only and must not be resold without our written consent.

Pre-Orders

From time to time, we may offer products for pre-order. A pre-order allows you to purchase an item that is not yet in stock or is scheduled to be released at a future date.

When placing a pre-order:

  • You may be required to pay the full amount at checkout

  • If a partial payment is taken, your payment method may be securely stored and charged for the remaining balance prior to dispatch

  • Estimated dispatch dates are provided in good faith but are estimates only and may change

By placing a pre-order, you acknowledge and accept that delays may occur due to production, quality control or shipping factors outside our control.

We reserve the right to cancel a pre-order and issue a refund if we are unable to fulfil the order.

SECTION 4 – PRICES AND BILLING

All prices are shown in the currency displayed on our website and are subject to change without notice.

Prices do not include shipping, customs duties, import taxes or other charges unless expressly stated. International customers are responsible for any applicable customs or import fees.

You agree to provide valid and authorised payment information and authorise us to charge the total order amount.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs authorities or events outside our control.

Risk and title pass to you upon delivery to the carrier.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services, including text, imagery, branding, logos, graphics, videos and designs, is owned by or licensed to St. MACI and protected by intellectual property laws.

You may use the Services for personal, non-commercial purposes only. Any unauthorised use is prohibited.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available”. We are not responsible for their content, functionality or accuracy.

Use of optional tools is at your own risk.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to third-party websites. We are not responsible for the content, policies or practices of third-party sites.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

St. MACI is powered by Shopify. All sales are made directly between you and St. MACI. Shopify is not responsible for any aspect of transactions between you and us, and you release Shopify from any claims arising from such transactions.

SECTION 10 – PRIVACY

Your personal information is handled in accordance with our Privacy Policy, available on our website. By using our Services, you consent to the collection and use of your information as described therein.

SECTION 11 – FEEDBACK

If you submit reviews, feedback or suggestions, you grant us a perpetual, royalty-free licence to use such content for any purpose, including marketing and promotional use.

SECTION 12 – ERRORS AND OMISSIONS

We reserve the right to correct errors or inaccuracies at any time and to cancel orders affected by such errors.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

You agree to indemnify and hold harmless St. MACI and its partners from any claims arising from your breach of these Terms or misuse of the Services.

If any provision is held invalid, the remaining provisions will remain enforceable.

These Terms constitute the entire agreement between you and St. MACI regarding use of the Services.

You may not assign these Terms without our consent. We may assign them without notice.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of NSW.

SECTION 22 – CHANGES TO TERMS

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
